1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by Esther, Inc. ("Esther," "we," "us," or "our"), including our website at estherapp.io and all related tools and features (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Esther provides an AI-powered image transformation tool that allows users to change material effects, colors, and visual styles of uploaded images and icons. The Service operates on a credit-based system where each transformation or download consumes one credit.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. You must be at least 18 years old to use the Service.
4. Credits and Payments
Credits are purchased via one-time payments processed by Stripe. Credits do not expire and are non-transferable. All prices are in USD and are inclusive of any applicable taxes unless otherwise stated. We reserve the right to change pricing with reasonable notice.
5. Acceptable Use
You agree not to use the Service to upload, process, or distribute content that is unlawful, harmful, defamatory, obscene, or infringes the intellectual property rights of any third party. We reserve the right to terminate accounts that violate these guidelines.
6. Intellectual Property
You retain all rights to images you upload. By using the Service, you grant Esther a limited, non-exclusive license to process your images solely to provide the Service. Esther's software, trademarks, and branding are the exclusive property of Esther, Inc.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Esther shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
8. Governing Law
These Terms are governed by the laws of Japan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Kagoshima District Court as the court of first instance.
